Recording and Protecting Miami-Dade’s Official Records

Juan Fernandez-Barquin

My office serves a critical role as the official recorder of all instruments for Miami-Dade  County. As Clerk of the Court and Comptroller, I am responsible for the recording,  protecting, preserving, and disseminating of official records. This includes documents  such as property deeds, mortgages, liens, certain affidavits, subdivision plats,  judgements, declarations of domicile, notice of commencements, satisfactions and  releases, powers of attorney, financial statements, court records, and dissolution of  marriage.

As the custodian of these records, I ensure these are accurately recorded and  accessible to the public. Residents and legal professionals can access these records  through the Clerk’s online portal or by visiting the office in person. My office also issues  certified copies of documents upon request, which can be crucial for legal, business, or  personal matters.

I am also responsible for maintaining a range of vital public documents beyond court  records. This includes property-related documents, marriage licenses, and more. My  office plays an essential role maintaining property records to ensure the integrity of title to a property. Additionally, I manage probate and guardianship records, issuing  marriage licenses, and overseeing tax lien and foreclosure records.

As Clerk my office is committed to expanding our digital transformation by offering  online access to public records, electronic document submissions and property fraud  notifications. I have recently rolled out the beta testing module of the official records  page on my website for ease of searching records with new functionalities, filters, and  search results with an updated user-friendly design.

To better serve our community, I am exploring the potential implementation of a mobile  application that will allow customers to record notice of commencements and  declarations of domicile on a self-service kiosk at future locations to facilitate the  recording of documents and other services.

These ongoing and potential future enhancements move towards e-government  efficiency and accessibility, allowing residents to save time, reduce costs, and handle  their legal and property needs with ease.
