Numerous questions are received concerning disabled parking and the payment for parking at either on-street metered spaces or public facilities and lots. Although this office does not issue parking citations, it is responsible forthe collection of citations on behalf of the issuing public agency.
Miami-Dade County, its municipalities, their law enforcement and local parking agencies oversee important parking accommodations for individuals with disabilities and access to the same for on-street metered spaces as well as public facilities and lots. To be eligible for such accommodations, drivers must display a valid disabled parking placard or license plate issued by the State of Florida.
Pursuant to Section 316.1964, Florida Statutes, vehicles displaying a valid disabled parking placard or license plate may park at on-street metered spaces for a maximum of four (4) hours at no charge. Unless a local ordinance has extended said time at no charge, after the four (4) hour period, the vehicle must be moved to avoid receiving a citation. These statutory efforts provide an attempted balance between the assistance of individuals with disabilities in maintaining access to convenient parking with the ongoing need for parking space availability in the more heavily trafficked areas.
When parking in any public agency’s facility or lot, said agency may charge any vehicle for parking. That stated and per the earlier referenced portion of the Florida Statutes, the only exceptions are for vehicles with specialized equipment for use by a disabled person, vehicles displaying the corresponding license plate for a disabled veteran, and vehicles displaying the Florida Toll Exemption permit.
