Key Biscayne Council members Franklin Caplan and Allison McCormick Found Guilty of Election Law Violations

The Florida Elections Commission recently found that Village of Key Biscayne Commissioners Franklin Caplan and Allison McCormick violated Florida election laws during their campaigns last year.

Franklin Caplan admitted to three violations in his successful campaign for the Village Council.  The Florida Elections Commission found “Respondent violated [Florida Statute] Section 106.021(3), 106.07(5) and 106.19(1)(a)” and imposed a penalty of $500.

The Florida Elections Commission found that Council member Caplan “made an improper expenditure,” filed a false campaign report and “accepted a contribution that exceeded statutory limits.”

Caplan is a real estate attorney at Berger Singerman and two-time Village mayor.

Commissioner Allison McCormick admitted to making an improper expenditure during her successful campaign and the Florida Elections Commission found that “Respondent violated [Florida Statute] Section 106.021(3)” and imposed a penalty of $300.

Both Caplan and McCormick were represented by the law firm of Stearns Weaver Miller and entered into Consent Agreements that were accepted by the Florida Elections Commission at its May 25, 2021 meeting.

The purpose of the Florida Elections Commission FEC is to “ensure transparency in Florida’s elections” by enforcing Florida’s elections laws.
