$28.9 Million Settlement Secured by Coral Gables Law Firm in Landmark Negligent Security Case Involving Teen’s Shooting Injuries

A landmark settlement of $28.9 million has been secured by The Haggard Law Firm in a negligent security case, following a tragic shooting incident that left a teenager with life-altering injuries. Led by Managing Partner Michael Haggard and partner Douglas McCarron, the firm’s success underscores the urgent need for improved security measures in residential complexes.

On April 17, 2023, 16-year-old Tedrick Moss was shot while visiting a friend at the Village at Delray apartment complex. The shooting left him a quadriplegic, necessitating emergency treatment at Delray Medical Center for serious gunshot wounds. Following several months of rehabilitation at Brooks Rehabilitation in Jacksonville, Tedrick returned home, facing significant physical and emotional challenges, including the requirement for 24/7 nursing care.

At the time of the incident, the Village at Delray was criticized for its lack of security measures, despite a troubling history of violent crimes in the area, including armed robberies and assaults. The high crime rate was further highlighted just one day after the shooting, when a grandmother was killed at a nearby apartment complex.

“This case takes on added significance in light of Florida’s recent tort reform legislation, HB 837, which was enacted on March 24, 2023. The new law poses challenges for plaintiffs in premises liability cases by allowing defendants to include the actual criminal as a party in the verdict and creating a presumption of non-negligence” says Haggard.

Despite these hurdles, Haggard and McCarron remained steadfast in their commitment to justice, indicating their readiness to take the case to trial. Their unwavering approach led to the settlement, marking it as the first major negligent security case resolved following the implementation of HB 837.
