In the latest update on the SW 87th Avenue bridge project that has been on the minds of many in the Village of Palmetto Bay, the Circuit Court held a hearing on July 5 to hear the village’s Motion for Summary Judgment in the bridge matter: Village of Palmetto Bay, Fl., et al v. Miami-Dade County, Case. No. 2022-003627-CA-01.
Village Mayor Karyn Cunningham commented about the latest ruling.
“This is an ongoing case and on July 5 both sides presented their arguments to the judge,” Mayor Cunningham said. “The judge will take all the information under consideration. There is no time frame for her to give us her judgement.”
The hearing concluded with the court giving both the village and the county 15 days to file respective “draft” orders, and the court will decide which side prevails. The public will be advised as to all subsequent actions.
Staff praised attorney Jessica Hernandez who represented the village and the two individual plaintiffs, Caroline Hetu and Craig Woischwill. Hernandez argued that the county resolution which approved the bridge project was not properly noticed for public hearing under the county charter.
The county charter mandates that any legislative action involving an appropriation of funds take the form of an ordinance, not a resolution, and also that the emergency ordinance did not contemplate that the construction of the subject bridge would fall within the scope of the types of matters which may bypass committee review.
If the court finds in favor of the village it remains to be seen what action the county would next take regarding the bridge project.
