Differing views on the Circuit Court’s decision regarding the proposed 87th Avenue bridge

Dear Friends and Neighbors:
Late yesterday, our Village of Palmetto Bay attorney was informed that the Circuit Court issued an Order granting Summary Judgment to Miami-Dade County concerning the matter of the SW 87th Avenue bridge project. While I am deeply disappointed with the ruling, I want to extend our gratitude to the two attorneys who flawlessly represented the village on a pro-bono basis, Norman Waas and Jessica Hernandez.

Unfortunately, this ruling is counter to our efforts to keep traffic away from our neighborhood streets and diminish cut-through traffic. The village has worked to decrease height and density in our community and supported infrastructure projects that keep traffic on arterial roads like Old Cutler and US1. The county and neighboring municipalities have green lighted development to the south and west of the village and in a large part it is this traffic that winds its way through our residential streets.

The village council will be meeting to discuss the court’s decision and determine the most appropriate course of action for the Village of Palmetto Bay in the future. We will continue to share more details with our residents as additional information becomes available.

It’s important to stay tuned to reliable sources of information. Please make sure to visit our website or follow us on social media to stay connected. From Miami-Dade Commissioner Danielle Cohen Higgins

A long overdue promise for the residents of South Dade and District 8 is finally being realized. When completed, this bridge will enhance the major arterial road that is 87th Avenue by connecting SW 164th Street to SW 163rd Terrace and will cross over the C-100 canal.

The court denied plaintiffs’ claims that residents were not able to provide input, holding that “any allegation that the county failed to provide notice and an opportunity to speak on the subject bridge matter is belied by the evidence.”

In its ruling, the court held that the process to place the 87th Avenue bridge on the board’s agenda revealed “no ambiguities.” The court ruled, “in accordance with the plain meaning of the text of Ordinance No. 20-38 and all other applicable laws and rules, the board properly added the proposed County Resolution No. R-88-21 to the agenda of its regularly scheduled Feb. 2, 2021, meeting and took action at that meeting to adopt it. Plaintiffs’ request to invalidate that resolution finds no support in any applicable law.”

“Today, is a win for the residents of District 8 and for Miami-Dade County as a whole,” stated Commissioner Cohen Higgins. “Miami-Dade is one of the largest growing metropolitan areas and we must ensure that our residents have the proper infrastructure that decreases traffic, enhances safety, and improves our county’s overall emergency response times.”

Public safety was the main impetus for this project, which was supported by a Miami-Dade County Fire Rescue study that showed 23 percent of life-threatening calls over the past four years, may have been impacted by a slower emergency response, as responding crews could not directly cross the C-100 canal. Upon completion, this new bridge will make it quicker and more convenient for our emergency services and our residents to reach their destinations.
